Terms of sale and use

1. Purpose

These terms of sale and use (the “Terms”) govern the use of Scale for You, published by the publisher identified in the legal notice (“we”), and the purchase of its paid plans.

Scale for You is an AI tool that builds Shopify stores and ads. It includes: a free audit of a public Shopify product page (mobile screenshot, rules-based score, AI review); the Studio (product photos, ad visuals, 9:16 UGC videos with an AI presenter and AI voice, product and landing pages); the “Scale for You” Shopify theme, downloadable with a license key; and the ad diagnostic and launch kit. Scale for You is software: it is not a coach and does not provide personalised advice. The human coaching offered by Tina Ecom is a separate, optional service, requested through a dedicated form.

2. Acceptance and eligibility

By using Scale for You, including the audit without an account, you accept these Terms. Scale for You is intended for adults who create or run an online business. If you use Scale for You on behalf of a company, you confirm you are authorised to bind it.

If you act as a consumer, you also benefit from the rights granted to you by law, including the French Consumer Code; nothing in these Terms limits them.

3. Your account

You sign in with a magic link sent to your email address — no password. Use an address that only you control and keep it secure: any action taken from your account is deemed to be yours. An account is personal. Let us know promptly of any unauthorised access.

4. Free plan and usage limits

• Without an account: 3 audits per rolling 24 hours, counted per IP address (stored as a fingerprint). These audits are public: anyone with the link sees their summary.
• With a free account: 20 audits per 24 hours, 5 Studio credits on sign-up, 10 ad diagnostics per 24 hours and the launch kit.
• With an active Starter or Pro subscription: “unlimited (fair use)” audits, with a technical anti-abuse cap of 100 audits per 24 hours.

Audits run while signed in are private by default; you can make one public to share it, and private again. An audit of the same page run in the last 24 hours is reused and does not count against your quota; a failed audit is not counted. Forms (waitlist, coaching request) are also rate-limited to prevent abuse. We may adjust these limits to protect the service and will inform you of changes that affect you.

5. Paid plans and prices

Prices include taxes, as displayed on the Pricing page at the time of order; the final amount is summarised by Whop before you confirm payment. Features announced as “coming soon” are not part of the plan until they are delivered.

6. Payment via Whop

Payments are processed by Whop, acting as merchant of record: Whop collects the payment, issues the invoice and applies the relevant taxes. Your purchase is therefore also subject to Whop’s terms and privacy policy. We never have access to your card details. If a payment fails, access to paid features may be suspended.

7. Renewal and cancellation

Your subscription renews automatically at the end of each period (month or year) until cancelled. You can cancel at any time from your Whop account (“Manage my subscription on Whop” link in your Account page). Cancellation takes effect at the end of the current period: you keep access until then, and no prorated refund is made, unless required by law.

If we change our prices, we will tell you in advance; the new price applies from the next renewal, and you can cancel before then if it doesn’t suit you.

8. Credits

Studio generations use credits (for example 5 credits for a product page). Each paid plan adds its credits with each payment: 100 (Starter) or 400 (Pro) per month; with annual billing, 12 months of credits are added at once when you pay. The credits needed are reserved when a generation starts and only those actually used are deducted: if it fails, they are returned to your balance.

Currently, unused credits stay on your balance from one period to the next. Credits have no cash value: they are non-refundable, cannot be exchanged for money and are non-transferable.

9. Right of withdrawal

If you are a consumer, you generally have 14 days from subscribing to withdraw, without giving a reason (article L221-18 of the French Consumer Code). This right applies as follows:

• Digital content: by starting a generation (photo, visual, video, page…) or downloading the theme, you expressly request immediate performance and acknowledge that you lose your right of withdrawal for that content, in accordance with article L221-28, 13° of the French Consumer Code.
• Subscription: you can withdraw within 14 days of subscribing if you have not yet used any benefit of the paid plan (plan credits, theme, paid-only features). Once you use one, you have requested immediate performance of the service and waived your right of withdrawal, to the extent permitted by law.

To withdraw, send us a clear statement by writing to the publisher using the contact details in the legal notice, for example using the model below. The refund is made via Whop, using the same payment method, no later than 14 days after we receive your request. The right of withdrawal does not apply to purchases made for business purposes.

10. AI-generated content

Content produced by Scale for You (texts, images, videos, voices, pages, recommendations) is generated by artificial intelligence. It may contain errors, inaccuracies or elements unsuited to your product. You must review and check it before publishing: you alone are responsible for what you publish.

• Transparency: videos with an AI presenter and AI voice are AI-generated content. Where regulations require it (notably the EU AI Act) or the platform asks for it, label them as such, for example with an “AI-generated” mention or the label provided by Meta or TikTok.
• No fake reviews: do not present generated content as a real customer’s testimonial, and do not publish claims you cannot substantiate (effectiveness, health, origin, results). Such practices are prohibited by consumer law.
• Platform rules: you are responsible for complying with the advertising policies of Meta, TikTok and Shopify, and with the laws applicable to your products and sales.

11. No guarantee of results

Scale for You helps you improve your store and ads, but does not guarantee any sales, conversion or profitability figures. Results depend on your product, market, budget and many external factors.

The audit score is indicative: it reflects the public page at the time of the screenshot, and its speed component may vary from one audit to the next. The ad diagnostic relies only on the figures you confirmed and on indicative thresholds shown next to your figures.

12. Scale for You Shopify theme license

With an active paid plan, you receive a non-exclusive, personal, non-transferable license to use the Scale for You theme on a limited number of stores: 1 store with Starter, 3 stores with Pro. The license is tied to a key; a store is linked to the license when it is first checked, within your plan’s limit.

• You manage your stores only from your Scale for You dashboard: detach a store (it can no longer re-link on its own until you re-authorise it) and close your license to new stores.
• Theme updates are included while your subscription is active.
• If you move from Pro to Starter, only your earliest-linked stores remain covered, within your new plan’s limit.
• If your subscription ends, a 7-day grace period applies. After that, the store stays online and readable, but the theme’s advanced features (such as the cart drawer, countdown timer or free-shipping bar) are disabled and a banner appears in the theme editor. They are re-enabled if you subscribe again.

Reselling, redistributing or sharing the theme or its key, or bypassing the license check, is prohibited.

13. Acceptable use

When using Scale for You, you agree not to:

• promote or sell illegal, dangerous or counterfeit products or services;
• upload photos, texts, faces, voices or trademarks you do not have rights to — you warrant that you hold the necessary rights to everything you upload;
• generate unlawful, misleading, hateful or discriminatory content, or content that infringes others’ rights;
• use the audit for anything other than analysing public pages, or bypass quotas (multiple accounts, automation);
• disrupt the service, attempt to access other users’ data, extract content at scale, or decompile or reverse engineer the software, except where permitted by law.

14. Intellectual property

You keep all rights to the content you upload (photos, texts, screenshots). You only grant us the right to host and process it, including through our AI providers, to provide the service.

To the extent permitted by law, we assign to you any rights we hold in the content generated for you, which you may use freely, including commercially. AI-generated content may not be protected by copyright, and similar content may be generated for other users: no exclusivity is guaranteed.

Scale for You, its software, methods, templates and the theme remain our property; these Terms only grant you the usage rights described in them.

15. Service availability

We make our best efforts to keep Scale for You available at all times, without being able to guarantee it: interruptions may occur for maintenance, updates or a provider outage. The service may evolve; we do not remove an essential feature of a current paid plan without notice.

16. Liability

Our liability is limited to direct and foreseeable damage, up to the amounts you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect losses (loss of revenue, customers, data or reputation), nor for content you publish. These limits do not apply in case of gross negligence or wilful misconduct, personal injury, or where the law prohibits them, in particular towards consumers.

17. Suspension and termination

If you breach these Terms, we may suspend or close your account, after notifying you except in urgent cases (fraud, security threat, manifestly unlawful content). If the closure results from a serious breach on your part, amounts already paid are not refunded, to the extent permitted by law.

You can stop using Scale for You and ask us to delete your account at any time, by writing to the publisher using the contact details in the legal notice. Remember to cancel your subscription on Whop first.

19. Changes to the Terms

We may change these Terms. For significant changes, we will let you know in advance by email or in the app. The new Terms apply from their effective date; if you do not accept them, you can cancel your subscription before that date.

20. Governing law and disputes

These Terms are governed by French law. If you are a consumer residing in another EU country, you keep the protection of the mandatory provisions of your country’s law.

If a problem arises, contact us first by writing to the publisher using the contact details in the legal notice: we always look for an amicable solution.

Failing agreement, the dispute will be brought before the competent courts. Consumers may bring proceedings before the court of their place of residence or any other court designated by law; between businesses, the courts with jurisdiction over the publisher’s registered office have exclusive jurisdiction.
